Terms of Service

Welcome to Ashdown Broadcasting. We are publishers and broadcasters of all forms of media, both in traditional print and digital. Access to and use of Ashdown’s web site and other Ashdown Internet services are subject to the following Terms of Service. Please read these Terms of Service ("Terms") carefully. By accessing the Ashdown Service will signify your acceptance of these Terms and constitute a binding agreement between you and Ashdown ("Agreement"). If you do not agree to these Terms, discontinue use of the Ashdown Service immediately. Ashdown acceptance is expressly conditioned on your assent to these terms.

1. Description of Service

The Ashdown Service is operated by Ashdown.co.uk Ltd ("Ashdown" or "We"). The "Ashdown Service" (or "Service") includes the numerous Ashdown Web sites that provides you the capability to order and subscribe to various magazines and other publications, and have digital versions of those publications or products delivered to you. The service also includes streaming IPTV stations.

2. Your Account

Certain portions of the Ashdown Service are available only to individuals who have registered with and obtained a password from Ashdown. By registering with Ashdown, you certify that you are at least 16 years of age. You may not provide or use a password, email address, or any other information of anyone else without the owner's authorization. You agree to provide true, accurate, current and complete information about yourself when you register with or order publications from Ashdown, and to maintain and promptly update that information to keep it true, accurate, current and complete. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account, including the selection and use of all content and services.

3. User Conduct

You may only use the Ashdown Service for lawful purposes and in accordance with these Terms, any operating rules established by Ashdown. Ashdown reserves the right to refuse service, terminate accounts, or cancel orders in its sole discretion, including, without limitation, based on any activity by a subscriber in violation of these Terms.

4. International Users

The Ashdown Service is controlled, operated and administered by Ashdown from its offices within the United Kingdom. If you access the Ashdown Service from a location outside the United Kingdom, you are responsible for compliance with all local laws.

5. Intellectual Property

All content included as part of the Ashdown Service, such as text, graphics, logos, button icons, images, as well as the compilation thereof, and all software used on this site, is the property of Ashdown or its suppliers and protected by international copyright laws. You agree to abide by all copyright notices, legends or other restrictions contained in any such content and will not make any changes thereto.

Ashdown expressly owns the copyright on content original to it including, without limitation, on the magazines and other publications delivered or otherwise made available to you by the Ashdown Service (the "Publications"). Except as permitted by the Publication's lawful owner, you acknowledge that you do not acquire any ownership rights by downloading copyrighted material.

Except as explicitly permitted under copyright law and by the features of the Ashdown Service, you may not modify, reverse engineer, publish, transmit, display, participate in the transfer or sale, create derivative works, or in any way commercially exploit or provide to a third party the content of the Ashdown Web site, the Publications, or any portion of them without the express permission of Ashdown and the copyright owner.

6. Third-Party Content

In some instances, Ashdown also acts a distributor of the Publications or other content supplied by third parties. Accordingly, we have no editorial control over such content. Any opinions, advice, statements, services, offers or other information or content expressed or made available by third parties, including those made in Publications offered by the Ashdown Service, are those of the respective author(s) or publisher(s) and not of Ashdown. Ashdown does not guarantee the accuracy, completeness or usefulness of any content, nor will we be liable for any loss or damage caused by your reliance on information obtained through the Ashdown Service.

The Ashdown Service may contain links to other Internet sites and third-party resources. Ashdown does not assume any responsibility or liability for communications or materials available at such linked sites. These links are provided for your convenience only. You are solely responsible for understanding any terms and conditions that may apply when you visit or place an order with a third-party site.

7. Modifications to Service

We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Ashdown Service (or any part thereof) with or without notice. You agree that Ashdown shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

8. Termination

Without limiting the foregoing, Ashdown may, in its sole discretion and without liability, terminate your password, or use of the Service for any reason, including, without limitation, if Ashdown believes that you have violated or acted inconsistently with the letter or spirit of these Terms. Any termination of your access to the Service under any provision of these Terms may be effected without prior notice, and Ashdown may immediately deactivate or delete your account and all related information and/or bar any further access to the Service.

9. Notification of Changes

From time to time, Ashdown may revise these Terms to keep them up to date with Ashdown products and services. Please refer to www.ashdown.co.uk periodically for any changes. The update date is used to alert you to recent modifications. Your access or use of the Ashdown Service subsequent to such an update or email notification will signify your assent to be bound by such changes.

10. Print Subscriptions

By submitting an order, you are making an offer to Ashdown to order or subscribe or buy that magazine, product or service. The publisher may accept or reject your offer in its entire discretion. Ashdown will supply the contact information, order and payment details you provide on your completed order form to the publisher of the magazine, product or service you wish to order. Confirmation of receipt of your order will be done by Ashdown by e-mail but is not confirmation that your offer to subscribe or buy has been accepted by the publisher. The publisher or its Ashdown agent will subsequently contact you by post or e-mail to confirm or refuse your order, in most cases within two weeks of placing your order on the Website. If you do not receive any such confirmation please contact Ashdown at support@ashdown.co.uk

No contractual obligations will arise until your offer to subscribe or buy is confirmed to you by Ashdown.

Annual Subscriptions are non-refundable and are renewed automatically at the end of the subscription period. You may cancel the auto-renewal at any time via the online link provided or by contacting our customer service team at support@ashdown.co.uk. We do not send out reminder letters or emails once the service has been cancelled.

Where under unforseen circumstances the publisher is forced to cease publication, the subscriber will be offered a replacement publication (which may be a digital version) for the remainder of the term. Where this is not possible, the subscriber will be refunded the remaining portion of their subscription, less the retail cost of the back issue catalogues and streaming services provided and an account administration charge of £45.00 ($60.00).

Our products are subject to price alterations as a result of increased material costs, delivery costs and exchange rate fluctuations. Recurring charges may, over time, increase or decrease and will be reflected in your subscription charges. We reserve the right to alter, or amend our publication schedule and frequency of the publications.

All credit or debit card information you provide is encrypted (and stored where a recurring subscription is required) using the latest Secure Socket Layer (SSL) technology, ensuring your credit or debit card details are safe and secure. These are handled by www.recurly.com whose website also meets the strict requirements of the Payment Card Industry Data Security Standard (PCI) which was created to ensure organisations that process card payments prevent fraud.

After your subscription has been set up by the publisher, the publisher will deliver or arrange for delivery of your magazine, product or service as soon as practicable. For printed magazines this is generally within 2 to 6 weeks.

Any problems with delivery should be notified to Ashdown at support@ashdown.co.uk

If at any time during your subscription you change address you should also notify Ashdown.

You may cancel the 'auto-renewal' of the subscription at any time. Your subscription will terminate automatically at the end of the said period.

All our annual magazine and digital subscription services are setup on a recurring billing system with Recurly.Inc, the trusted billing platform for thousands of companies worldwide.

You may request the auto-renewal be terminated at anytime during the year and before the anniversary date. The email sent to you when signing up has full details of the renewal date and our policy.

There are no refunds for magazines offered on an annual basis.

In special circumstances we can offer a 30 day cancellation for customers in financial difficulties. Any refund will be made pro-rata at the end of the 30 day cancellation at at the discretion of the publishers.

10a. Digital Subscriptions

By submitting an order to our i-mag service, you are making an offer to Ashdown to order or subscribe to the streaming magazine service. The publisher may accept or reject your offer in its entire discretion. Ashdown will supply the contact information, order and payment details you provide on your completed order form to the publisher of the magazine, product or service you wish to order. Confirmation of receipt of your order will be done by Ashdown by e-mail but is not confirmation that your offer to subscribe or buy has been accepted by the publisher. After your subscription has been set up by the publisher, you will be granted access to the i-mag portal. You will have full access to all available back issues of the title for the duration of your subscription term. During this time you may browse and print off for your own personal use, content from the magzines on the strict understanding that all copyright remains the property of the publisher and cannot be shared or distributed to any third party whatsoever.

Once the subscription period has ended or terminated you will no longer have access to the digital library.

Any problems with access should be notified to Ashdown at support@ashdown.co.uk

Your IP is duly recorded and tracked by Ashdown and if repeated requests are received from numerous locations, your account will be suspended pending our technical team's purusance.

11. Online Transactions

Online transactions including credit card transactions at Ashdown sites are secured using the SSL encryption method and hosted with Recurly.Inc. This is to provide ultimate security and protection to our customers. We also accept credit card payments via Paypal, a credit card processing service people all around the world know and trust. Recurly Inc is the preferred Data Processor for our services and, where a recurring subscription has been setup, yout payment information will be held securely on their servers.

Ashdown.co.uk Ltd does not store any credit/debit card details on or offline.

12. Shows and Events

Ashdown.co.uk Ltd organises a number of shows and events throughout the year. Ashdown makes no warranty whatsoever for the vendors who rent space for the display and the sale of goods at such events. Any purchases made from these vendors is a direct transaction between the buyer and the seller and subject to the UK Sale of Goods Act and any other relevant legislation. Any complaints, refunds or customer queries regarding purchases from these vendors should be made directly to the vendor(s) themselves. A full list of vendors can be found on the event/show plan.

Ashdown takes no responsibility whatsoever for the vendors and exhibitors at these events.

In the unlikely event that any show or event has to be cancelled your tickets will not be refunded but valid for an alternative Big Bead Show at a later date.

 

 

13. Advertisement Terms

The word "advertisement" will be placed above all ads that, in Publisher's opinion, resemble editorial matter.

Recognised agencies will be entitled to a ten per cent discount

Any creative elements produced for an advertisement will incur additional charges.

Cancellation of advertisements will only be accepted 6 weeks prior to the copy deadline for that booking.

Publisher is not liable for any failure or delay in publishing any advertisement submitted to it.

Publisher does not guarantee positioning of advertisements in the Magazine or availability of magazine on specific devices.

Pre-payment is required from first time advertisers.

All major credit cards are accepted in payment. All payments must be made payable to Ashdown Broadcasting.
